Teacher Sues Student for Name Calling

Wow. What’s the world coming to when a student gets sued for making fun of the teacher? Sure, it’s not a great character quality to make fun of other people, but what kind of teacher sues a student for something silly like this?

Teacher Robert Muzzillo pursued the charges against Alex and another student after noticing a profile with his name attached on MySpace.com. The profile talks about Muzzillo liking Michael Jackson and having a “gay old time,” like the Fred Flintstone song.

Davis said he only wrote that Muzzillo lost an eye wrestling with alligators and midgets.

When the school found out that Davis was involved, he received three days in-school suspension. Then he learned the teacher had filed charges against him.

  2. Some things really are hurtful. Accusing a teacher of pederasty is libel per se. These kids accused the teacher of criminal acts that require the end of the teacher’s career.

    That’s not just a bit of name calling. That is vile, hateful and wrong. If it takes a lawsuit to clear up the circumstances, it takes a lawsuit. If the kids have a competent lawyer, they’ll post a suitable retraction to reduce the damages.

    Those of use who have professional licenses upon which our livlihoods depend — preachers in some states, counselors, nurses, physicians, lawyers, airplane mechanics, and teachers — take it seriously when we are accused, falsely, of activities that are unethical in our trade, or illegal, or which question our competence to hold the license.

    It’s not name-calling. It’s slander, and it’s a sin.

  3. rmuzzillo@henry.k12.ga.us let the teacher know what you think about him doing this…. it’s wrong, sad, pathetic, and he needs to find better use of his time than harrasing a cihld for doing what most every student has done in there time… making fun of a teacher… it comes with the job and if he can’t handle it he needs to find a new profession

  4. There’s very little information about the kid in general.

    If this kid has no prior history of such behavior, the teacher is going way overboard. On the other hand, if this kid has a negative influence on his classmates and nurtures deception in everything he does, perhaps more energetic actions are needed.

    Even then, I’m very sceptical that the court can deal with this matter with enough smarts so that everyone can “learn” from this and move on to more productive things.

  5. I absolutely support the teacher. It’s about time that teachers “fight back” against libelous students. This kid is old enough to know right from wrong and what’s true or not. I hope the teacher paves the way for other teachers to stop being such wimps and taking it up the @$$ from their students.

  7. The teacher harrassing the child? Hardly. The teacher has been slandered and defamed in a public forum. Children (and apparently some adults) need to understand that online journals are public forums and the things they are responsible for the things they write. Good for the teacher. Too many teachers take the “oh, they’re just kids” excuse road far too often. How are children supposed to learn accountability and right from wrong if they are never held accountable for their actions and/or if they are allowed to just say or do whatever they want whenever they want with no consequences, no matter who is affects?

    The teacher is going overboard? Hardly. Reacting to a slanderous statement with legal action is hardly going overboard. This is not a case of a child simply poking fun at his teacher. This child’s statement could affect this teacher’s reputation and employment, so protecting that and fighting against it is hardly “going overboard”. Just because the perpetrator is a child doesn’t make it any less viable of effective. Dealing with this situation is “productive”. The “oh, they’re kids so get over it” mentality is irresponsible of the adults and paves the way for children to believe it’s alright for them to be equally irresponsible and ultimately unaccountable for their actions. Wrong. This kid has to answer for his actions. A retraction would likely suffice, but the overall message is most important - we are all accountable for our actions — all of us.

  8. I support this teacher 100%. Some students and parents have little regrad for rules and consequences. When consequences are enforced students can be very vendictive and have little regard for what they say against teachers, and those same students have bully parents that come to school and intimidate, accuse, and harrass teachers! WE SHOULD HAVE RIGHTS TOO! It’s not right, that permissive mentality is creating the social problems we have with many of these kids. We are the adults and they are the children…A permissive culture leads to a moral breakdown and ethical breakdown.

  9. I just had a student make fun of me. It hurt my feelings and it sure doesn’t make me peppy to go back…who needs a job to make you feel awful? Life’s too short…I’m postulating…

  10. well , students are doing the same thing to teachers these days, so it serves them right, teachers should have the same rights , my wife was verbaly abused by a student and nothing was done about it, she later took early retirment due to stress, but none of the students took her feelings into consideration.

  20. Teachers get bullied by students everyday and it is not right. In the last week alone, I have been pushed, “happy slapped”, told to _uck off, been ignored, had my worked erased etc etc etc. Yes - sue away - teachers have little recourse but to turn to legal avenues for protection. It’s a sad day.

  21. God Bless that teacher! It’s about time teachers quit taking it from disrespectful parents and children! School systems now cater to such parents out of fear, and that’s why our entire country is eventually going to be too far gone to salvage. That teacher is a true AMERICAN HERO.
