Judge Edward Cashman Doesn’t Believe in Punishment

The most outrageous story of the day month comes via WCAX.

There was outrage Wednesday when a Vermont judge handed out a 60-day jail sentence to a man who raped a little girl many,many times over a four-year span starting when she was seven.

The judge said he no longer believes in punishment and is more concerned about rehabilitation.

Prosecutors argued that confessed child-rapist Mark Hulett, 34, of Williston deserved at least eight years behind bars for repeatedly raping a littler girl countless times starting when she was seven.

But Judge Edward Cashman disagreed explaining that he no longer believes that punishment works.

“The one message I want to get through is that anger doesn’t solve anything. It just corrodes your soul,” said Judge Edward Cashman speaking to a packed Burlington courtroom. Most of the on-lookers were related to a young girl who was repeatedly raped by Mark Hulett who was in court to be sentenced.

The judicial system may not only be about punishment, but it plays a key role. For what kind of case was the judge saying punishment is inappropriate? Was it a traffic offense? Was it a civil case requesting punative damages? Nah, nothing important like that. Just a minor case of some scumbag repeatedly raping a young girl from age 7 to 10. This rapist should not have lived to reach trial and the judge sentences him to 60 days in jail. 60 days! Unbelievable. This judge should be removed from the bench forthwith.

  6. I am wondering if Judge Cashman may be a pedophile himself. Many pedophiles are in high profile positions throughout the country. Giving the child rapist 60 days may be the judge’s way of “supporting the cause.”

  8. Judge Cashman is the epitome of evil as he and other lenient and liberal judges continue to disgrace the US judicial system. By judicial fiat, this incompetent judge has injected his own feelings of bias and rationalizes that punishment accomplishes nothing. This is NOT ABOUT ANGER, PUNISHMENT OR RETRIBUTION judge! This is ALL ABOUT RISK that this animal poses to young children! This man is a serial rapist and is only considered a low-risk offender? How insane! Rehabilitation? You’ve got so be kidding! And even if this were possible? So what! Irrelevant your honor! The only appropriate sentence for child sex offenders is either life in prison without parole or death. I am astonished at the fact that many thousands of convicted child predators and other sex offenders receive light sentences and are released into society’s mainstream yearly. Any government that fails as miserably as America does at protecting its citizens can hardly be considered a great nation.

  10. Well, justice may yet be served. Hopefully during those 60 days he is spending in jail, someone tips off the other inmates as to what this guys crime is and how lenient his sentence is. If he was sent to Oz, 60 days would be more than enough of a punishment for this guy.

  15. You people are scary. The man made one bad call in his career and you want to throw him to the wolves. Maybe he is right and it will work. If not than this is something that he will be forced to live with for the rest of his life. It was his ruling to make and no matter what the outcome it is him that has to live with what happens.   17. I am appalled at his decision and could not believe the out come.
    I think Cashman should be given a 60 day NO Pay suspension and the creep given the 8 years to life he deserves, and then let the creep out during Vermont hunting season with a brown coat and a set of antlers(remember at least 3 points).

  19. to dave, and all other decent residents of VT, I feel for you all. Cashman might just as well have launched a nationwide campaign offering pedophiles a haven: “Come to Vermont for YEARS of pedophilic fun! And if you get caught, no biggie! You’ll receive almost no jail time and all the “help” you need!”

    I believe in psychiatric treatment for criminals but I also think there’s nothing wrong with good ol’ fashion punishment for crimes. If years of sexual abuse of a child doesn’t earn you a LONG jail sentence, what (besides murder, I hope) does?

  21. Judge Cashman needs to be removed immediately! What was he thinking?? I have worked in Vermont prisons and I can tell you that this guy will get his just desserts. Other inmates watch alot of tv, high profile cases like this one does not bode well for this offender. He will get his, for that I’m quite sure of.

  22. I do not live in Vermont but I am scared that other judges might begin to follow suit if swift action is not taken to remove Judge Cashman from the bench immediately. I would not be suprised if in 60 days when this monster is released, a citizen with a vengence took matters into his or her own hands. People do not stand for our innocent children being mistreated- she is scarred for life an he should do the same time.

  26. Someone mentioned Cashman made his decision and HE will have to live with it. What about that girl and her family, not to mention the rest of us. Our laws are put in place to keep people safe. When you step outside of these laws, you pay what is called a penalty. Laws are here to protect the innocent and punish the not-so-innocent, not to identify people who need therapy!
    And this offender wouldn’t need therapy if he was kept in an environment that was free from children, I don’t know….jail maybe!

  28. I am a probation/parole officer in Vermont and I supervise sex offenders in the community. I hate to say, that a sentence like this in Vermont is not as unusual as we would all like to believe. What really infuriates me however, is the reasoning for this particular sentence. Judge Cashman no longer “believes in punishment” I don’t care if he doesn’t believe in punishment, taxes or the Easter Bunny the courtroom is not the appropriate place for him to use as his personal forum to voice his political opinions. It is obvious that he is unhappy with the Department of Corrections and feels that we should treat Hulett while incarcerated. That is his ill informed opinion. Since he won’t receive treatment until he is in the community, Cashman will give him two months in jail so Hulett can get started right away. I mean come on! Treatment now or treatment 5 years from now. As far as I know, there aren’t any statistics to substantiate that offenders who receive treatment immediately after offending recidivate less than offenders who receive treatment after an incarcerative sentence. Nobody in this state seems to care about the 11 year old victim. This should NOT be all about punishment or the offender and his rehabilitation, this should have first and foremost been about a little girl who was horribly victimized for 4 years and will continue to be victimized in one way or another for the rest of her life. Put him in jail, at least until this little girl is out of high school and able to take care of herself and grow up a little bit, THEN he can get out of jail and get treatment. This is just total insanity and I have been banging my head against the wall trying to make sense of it all.

  30. I have first hand knowledge of Judge Cashman’s dealing’s. He hasn’t changed!
    I married a beautiful women who as a young child was molested by her father for many years until she was able to escape and have him prosecuted (with no help from her mother).
    Cashman did put him in jail, just to let him out in 2 years for “GOOD BEHAVIOR”.
    She lives each and everyday knowing that he was let out and she had to face everyone every day thinking she was lieing, “because if she wasn’t he would still be in jail”.

    This has affected her for that last 30 years and will forever.

    Remember the victim, put the Bastard away so this precious little child can live as normal a life as possible (if possible) for the rest of her life.

    Once he’s in jail it will only be a matter of time that he will be delt with by the inmates that are in there for a longer peirod of time for a much lesser crime!

    If he only gets 60 days hopefully someone will help out the rest of society by eliminating him!!!

    Pray for the victim, and impeach the judge and all others that support him!!!!!!!!!!!

    PLEASE PRAY !!!!!! We Vermonters are!

    Sexual predation on children is in my opinion one of the most heinous crimes committable. No one can know for a fact wether or not Mark Hulett will repeat his offense. However, it is all too common that sexual predators are also repeat offenders.

    Public outrage, while in part, clammers for justice in the form of punishment, also recognizes the dangerous message that this sentence sends to practicing and latent sexual predators.

    I agree that rehabilitation is fundamentally important in the bettering of society. However, the threat of severe punishment serves as a powerful deterrent to offense on the whole. Conversely, a slap on the wrist for such a horrific offense as Mark Hulett’s may very well be an invitation to those who would willfully destroy the lives of other children in this nation.

    Impeaching Judge Cashman won’t change the sentence that he delivered. However, it will help correct the message that “You can get away with raping a child.”

    You have the opportunity and power to deter sexual predators from acting on their tendencies by calling for the impeachment of Judge Cashman. Please do you duty, and make this nation a little safer for my little girl.

    If he does not believe in punishment, he cannot do his job. The judge says 60 days and treatment will be a better deterrent to his repeating his offense than a long prison term. WRONG!!! 50 years of sphincter splitting and getting out at the age of 84 would be a greater deterrent.

  35. Why is that vermont doesn’t take action to deal with the disgracful sentence handed down by Judge Cashman
    and why is it that 40 other states in this union know how to deal with sex offenders and vermont does not? In Minn. we hand down long lengthy sentences, we provide treatment while they are incarated and we allert the public when a known sex offender is to be released. We have regulations as to where that sex offender can and can not live once he is released and he is placed on stricted supervision and monitored by electronic devises for a peroid of time while under that supervision. If a sex offender refusses treatment while incarated, he may not be released into the community but forced instead to a hearing as to whether it is safer to have him to be detained in a mental facility tilll it can be determinded he has satisfactorly acknowledge his offense and knows the gravity of what he did and has sucessfully completed treatment to the satisfaction of those treating him.
    This disgrace that Vermont faces today will not go away in a few weeks when the heat dies down. Tourism and travel will be effected as word spreads, and Lord help Vermont if a child is killed by the next sex offender such as the highly publicized cases over the last few years in other states. It has been said that that this offender has the IQ of a 14 year old and if true, what benefit whould treatment have for this man who reasons life from the view point of a 14 year old. Doesn’t sound like the public would be safe nor the children safe from a man who cannot reason llife as a adult but thinks as a 14 year old boy. He needs to be locked up for a long time for the safety of the general public. Whether Cashman is removed from the bench or not, Vermont owes its people and that victim the peace of mind to know they can walk the streets without running into this man on the sidewalk. Vermont needs to create a task to look into and recommend changes in the sentencing guide lines, and how they will treat or not treat thier sex offenders in the near future. Perhaps the Dept of Corrections also needs to rethink how they deal with sex offenders too. So far, Vermont has enough bad press, it’s courts and its judges are being talked about by the whole country. Vermond’s Governor needs to stand up and be counted on this also. He has enough power to effect some change and he needs to come up and be counted. This is terrible and such a disgrace, my heart goes out to the tiny victim who had no one who would protect her then and it almost appears now that no one will protect her now.. Shame on Vermont

  37. governor douglas, you have to take action on judge cashman.by his own admission states that he feels that the only way to deal with pedophiles is pyhic treatments. he is wrong, these animals needs to be put away for a very long time so they cannot prey on any more children in our society. you must pass jessica’s law in vermont so people like cashman, has to sentince pedophiles to the extent of the law. please take action on cashman now and send this rapist to prison where he belongs. your state does not want to go through a boycott.

  39. Kudos to Bill O’riley for bringing this to the attention of the world with his tv show. This Judge needs to be put in prison with this child molester–put them both in there with the “cons who are lifers” & then see what they both have to say about the treatment. Everone needs to pray for that poor girl who lived/lives with all of this & all the children/people big & small who have been abused in their lives..shame on Judge cashman & the Govenor for letting this go on so long–all of you need to be impeached

  42. Evil is alive and well in Vermont. It goes without saying that the rapist is an evil man. Now we see the harvest of years of liberalism. The very person who is entrusted with the responsibility of delivering justice, has delivered evil back on the streets of Vermont in a mere 60 days. I had planned to visit Vermont on my quest to see all 50 states, but if Howard Dean and Edward Cashman are the best leadership Vermont can come up with, they can keep their state and their maple syrup. I would like for this child and her parents to know that they are more than welcome to come South where common sense still exists. The state of Vermont has perpetrated the second crime on this child, by not immediately removing this judge, who obviously does not comprehend the scope and responsibility of his position as a judge.     Myself as a native Vermonter would like you to know that we here in VT are good people with strong views and ideas.
    And we are trying the best we can to have Mr. Cashman reverse his decision.
    My blogs were #17 & 30.
    If you read my blogs you will see that I DON’T agree with Mr. Cashman in this decision, nor do too many other Vermonters.
    As for Mr. Dean he was very good for our state just not for our country.

    If you choose not to come to Vermont and visit our beautiful Green mountains and lovely country sides.
    To Fish or Boat on our many lakes, ski some of the best mountains in the east, Taste the worlds best Maple syrup or meet some of the nicest people in America.

    That’s fine!

    I welcome you to stay where you are and visit the other 49 states (unless of course their is someone in those states you don’t like!).
    We don’t feel the lost that you will!
    We are very content with you not coming here and we probably won’t even know your not here.

I hope that this issue and the national attention it is receiving will remain focused on the removal and rebuke of a judge for issuing a sentence that might encourage the further willful destruction of our children’s lives. This national attention will loose much of its impact if it dissolves into a reckless debate between political parties. Liberals and Conservatives alike deplore with Cashman’s recent sentence and the underlying litigious environment that allowed such a sentence.

    I hope that the attention of this case will deeply stir Vermont legislative powers to join together to correct their flawed legal system, which has proved completely ineffective in this matter.

    Mandatory sentencing for crimes as heinous as this, have proven to reduce crime. However, it is unclear to me if this is because many crimes go unreported under these circumstances. I have heard compelling argument that suggests juries are less likely to convict when the defendant is faced with a mandatory sentence. If this is true, then mandatory sentencing could potentially put victims in an extremely vulnerable position and ironically, may not be in the victim’s interest. When acquitted, rapists don’t get any jail time or probation and they are not registered as sex offenders.

    I don’t know that I agree or disagree that sex offenders can be treated effectively with rehabilitation. The relatively high levels of recidivism suggest to me, that they cannot. However, it should deeply concern all of us that until a recent development in the Hulett case, rehabilitation concurrent with sentencing was not an option.

    Cashman’s decision was based heavily on his belief that prompt rehabilitation was necessary. Being that other judges and even lawmakers may believe similarly, does it not make sense to have a legal system that offers rehabilitation concurrent with a reasonable amount of time behind bars?

    Last Friday Cashman was given the opportunity to re-evaluate the terms of his sentence based on an unconventional option of rehabilitation concurrent with the sentence. We’ll see what he does.

    The really despicable aspect of this case, is that the sentence is held up by a plea-bargain. This means that even if Cashman were to through the book at Hulett after re-evaluation, Hulett could then withdraw his guilty plea!!!

    I think Cashman should look past the plea-bargain in this case and redeem himself by sentencing Hulett to jail for life. The national attention that this case has received should be more than enough to convict Hulett now! If not, Cashman’s removal from the bench will rightfully help to balance this outrageous travesty of justice!

  48. Judge Edward Cashman needs to go back to Law school and take some refresher courses…
    develope a conscious…consider if that was his child or grandchild….but most of all - he needs to
    “RESIGN”….he has more “guilt” than the “sick” man who did this. The Judge has to know the guy is
    gonna do it again and again…With guys like him and the ACLU we won’t have any Laws pretty soon.
    Not if they get their way - We need to stand up.

  50. Actually, I think the sentence would be quite fair, with a couple of modifications:

    1.) We tattoo “Child Molester” on his forehead in red ink
    2.) We drop him into the prison yard when all the convicts are out
    3.) The warden and all the guards get the day off

    You can’t rehabilitate garbage like this. All you can do is step on it like a cockroach.
